The case before the Supreme Court involves only that last charge. All three defendants appealed to the Supreme Court, but the justices granted only Fischer’s case. In a filing last week at the Supreme Court in Trump’s immunity case, Smith argued the obstruction charge should stick against Trump even if Fischer wins.

The email referred to the 2024 October term of the court, and the tone was jubilant: “Please take a look at these posts of congratulations and support. In 2019, at the Thomases’ urging, Ms. Clanton enrolled at Antonin Scalia Law School at George Mason University in Virginia, where Justice Thomas has taught. She received a full merit scholarship, according to another judge who later hired her.

The real question, then, is if Congress fails to act, should the administrative agencies be the second choice or the courts. I am confident that the administrative agencies are the better choice. Courts are not experts and are not responsive to the electorate. By contrast, administrative agency heads are appointed by the current president, who, the Electoral College notwithstanding, is responsive to the will of the people. Moreover, unlike judges, administrative agencies have true subject matter expertise, and that was the entire premise of the Chevron decision, as noted by no less a jurist than Justice Antonin Scalia.
